Terms & Conditions

These Terms & Conditions apply to quotations, bookings, deposits, equipment supplied, installations, support services, invoices and other works completed by NextWave Tech & Security.

Our Commitment to You

NextWave Tech & Security is committed to transparent pricing, honest advice and professional installation standards. We stand behind our work with a 3-Year Installation Workmanship Warranty. These Terms & Conditions explain the responsibilities of both NextWave Tech & Security and our customers.

1. Quotations & Pricing

  • All quotations issued by NextWave Tech & Security are valid for 7 days from the date of issue unless a different validity period is stated in writing.
  • Due to fluctuations in supplier pricing, freight costs, foreign exchange, electronic component availability and product supply, a quotation may be reviewed, amended or withdrawn after its validity period has expired.
  • Quotations are based on the information reasonably available at the time they are prepared, including information supplied by the customer, photographs, plans, online property information and any site inspection completed before quoting.
  • Unless specifically stated, quotations assume reasonable access, standard construction methods and normal installation conditions.
  • Typographical, calculation or administrative errors may be corrected before equipment is ordered or works commence.

2. Acceptance of a Quotation

A customer accepts a quotation and these Terms & Conditions by any of the following:

  • Accepting the quotation electronically through our quotation system.
  • Providing written approval by email, text message or other written communication.
  • Providing clear verbal authority for us to proceed.
  • Paying a deposit or making part payment.
  • Booking an installation after receiving the quotation.
  • Allowing equipment to be ordered or works to commence.

Once a quotation has been accepted, NextWave Tech & Security may order equipment, reserve stock, allocate technicians and schedule the works.

3. Deposits & Equipment Orders

  • A deposit may be required before equipment is ordered, stock is reserved or an installation date is confirmed.
  • Unless otherwise stated, any deposit amount and payment due date will be shown on the quotation or deposit invoice.
  • Deposits applied to special-order, configured, customised or customer-specific equipment may not be refundable once that equipment has been ordered, allocated or configured.
  • If a customer cancels after equipment has been ordered, reasonable supplier cancellation fees, restocking fees, freight charges, configuration costs and other costs already incurred may be deducted from any amount otherwise refundable.

4. Scope of Works & Variations

  • The quoted scope is limited to the goods and works specifically described in the accepted quotation.
  • Additional work requested by the customer or required due to unforeseen site conditions will be treated as a variation.
  • Variations may include additional labour, materials, cable, conduit, mounting hardware, access equipment, travel, programming, configuration or attendance by another licensed trade.
  • Where practical, we will advise the customer of the likely additional cost before completing a variation.
  • Where immediate action is reasonably required for safety, equipment protection or completion of the agreed works, reasonable additional costs may be charged even where a formal written variation cannot be obtained beforehand.
  • Where a customer chooses to modify, reduce or decline recommendations made by NextWave Tech & Security relating to equipment selection, camera placement, recording capacity, Wi-Fi coverage, network design, wireless links, alarm devices or other aspects of the proposed system, NextWave Tech & Security is not responsible for any resulting limitations in performance, coverage, functionality, recording duration or future expandability.

5. Site Access & Installation Conditions

  • Customers must provide safe, clear and reasonable access to all work areas at the arranged installation time.
  • Customers must advise us of known hazards, asbestos, fragile roofing, concealed services, unsafe structures, restricted areas, animals, contamination or other relevant site conditions.
  • Additional charges may apply for steel framing, double-brick walls, concrete, asbestos-related restrictions, difficult ceiling access, fire blocks, insulation, inaccessible cavities, excessive conduit, trenching, underground services, non-standard mounting surfaces, elevated work, specialised access equipment or other unforeseen conditions.
  • We may stop, postpone or refuse work where our technicians reasonably consider the site or requested method unsafe, unlawful, unsuitable or outside the agreed scope.
  • If our technicians attend and cannot proceed due to customer absence, lack of access, unsafe conditions, incomplete third-party works or another matter outside our control, a call-out, travel or labour charge may apply.

6. Electrical Work & Other Trades

  • Power points, electrical alterations and other 240-volt electrical work are not included unless specifically stated in the quotation.
  • Electrical work must be completed by an appropriately licensed electrician where required.
  • Work involving builders, roofers, locksmiths, electricians, excavators, internet providers or other third parties is excluded unless specifically included in writing.
  • NextWave Tech & Security is not responsible for delays or defects caused by third-party contractors or services outside our control.

7. Customer-Supplied Equipment

  • Customer-supplied equipment may include televisions, brackets, cameras, alarm devices, Starlink equipment, networking equipment, hard drives, mounts, cables and other products not supplied by NextWave Tech & Security.
  • We do not guarantee the quality, compatibility, performance, completeness or condition of customer-supplied equipment.
  • Additional labour may apply where customer-supplied products require unexpected assembly, adapters, troubleshooting, software updates, account recovery or configuration.
  • We may refuse to install customer-supplied equipment that we reasonably consider unsafe, damaged, unsuitable, poor quality, incompatible or non-compliant.
  • Our workmanship warranty does not cover faults within customer-supplied products.

8. Three-Year Installation Workmanship Warranty

NextWave Tech & Security warrants its installation workmanship for three (3) years from the date the installation is substantially completed.

If a fault arises solely because of our installation workmanship, we will, at our option, inspect, repair or rectify the workmanship defect within a reasonable time and at no charge to the customer during the warranty period.

This warranty applies only to defects that are directly and solely attributable to our installation workmanship, such as an incorrectly installed fixing, cable termination, mounting or connection.

The workmanship warranty does not cover:

  • Manufacturer defects, internal product failures or faults covered under a manufacturer's warranty.
  • Normal wear and tear, ageing or expected deterioration.
  • Accidental damage, misuse, neglect, vandalism or deliberate damage.
  • Power surges, lightning, storms, flooding, fire, vermin, corrosion, moisture or other environmental causes.
  • Building movement, structural defects or deterioration of the mounting surface.
  • Faults arising from customer-supplied equipment or existing customer infrastructure, including cabling, conduits, electrical wiring, internet services or network equipment not supplied or installed by NextWave Tech & Security.
  • Routine maintenance, cleaning, firmware or software updates, battery replacement, vegetation removal, lens cleaning, network reconfiguration or preventative maintenance.
  • Any part of the installation that has been altered, repaired, relocated, disconnected, reconfigured or otherwise modified by anyone other than NextWave Tech & Security without our written approval.

Customers must notify NextWave Tech & Security of any suspected workmanship defect as soon as reasonably practicable after it becomes apparent. Delays that result in additional damage may affect warranty coverage.

The workmanship warranty applies only to the original installation address and the original customer unless otherwise agreed in writing.

We reserve the right to inspect any reported defect before determining whether it is covered under this warranty. If the reported issue is found not to be caused by our workmanship, reasonable call-out, travel, labour, diagnostic and any specialised access costs may apply where permitted by law.

Nothing in this workmanship warranty extends or renews the original warranty period.

Any warranty service performed under this workmanship warranty is limited to rectifying the workmanship defect and does not include upgrades, improvements, relocation of equipment, expansion of the system or changes requested by the customer. Such work will be quoted separately where requested.

9. Product Warranty

Products supplied by NextWave Tech & Security are covered by the applicable manufacturer's warranty.

If a product develops a manufacturing fault during the warranty period, we will assist with the manufacturer's warranty process and, where approved, arrange the repair or replacement of the faulty product.

Our 3-Year Installation Workmanship Warranty covers the quality of our installation only and is separate from the manufacturer's product warranty.

Where a product has failed due to a manufacturing defect and the original installation was completed correctly, any labour, travel, access equipment or reinstallation required to replace the faulty product may incur additional charges.

Nothing in these Terms & Conditions excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law.

10. CCTV, Alarm & Security Systems

  • CCTV, alarm, access-control and security systems are designed to reduce risk and assist with detection, deterrence, notification and evidence collection.
  • No security system can guarantee that theft, trespass, fire, property damage, unauthorised access or other incidents will be prevented.
  • System performance may depend on camera positioning, lighting, weather, obstructions, user settings, internet connectivity, mobile coverage, power availability and third-party services.
  • Customers are responsible for operating the system correctly, maintaining passwords and user access, responding to notifications and maintaining suitable property and contents insurance.
  • Recording duration is an estimate and may vary depending on motion, resolution, frame rate, compression, scene activity and storage settings.

11. Starlink, Wi-Fi, Networking & Wireless Links

  • Internet speed, latency, coverage and reliability depend on factors outside our control, including the internet provider, customer plan, network congestion, building construction, device capability, interference, weather and line of sight.
  • Wireless bridges and outdoor links require a suitable and substantially unobstructed line of sight. Trees, vegetation, buildings and new obstructions may reduce or interrupt performance.
  • Wi-Fi coverage and speed cannot be guaranteed in every part of a property unless specifically tested and included in the agreed design.
  • NextWave Tech & Security is not responsible for outages, speed reductions or service changes made by Starlink, an internet provider, mobile carrier, cloud provider or equipment manufacturer.

12. Apps, Accounts, Cloud Services & Remote Access

  • Some systems rely on manufacturer applications, customer email accounts, mobile devices, cloud platforms, subscriptions, SIM services or third-party infrastructure.
  • Customers are responsible for maintaining current contact details, passwords, multi-factor authentication, subscriptions and compatible mobile devices.
  • Third-party providers may alter, discontinue, restrict or charge for their applications, cloud services, features or subscriptions.
  • We cannot guarantee uninterrupted remote access or notification delivery where a third-party service, internet connection, mobile network, power supply or customer device is unavailable.

13. Data, Recordings & Backups

  • Customers are responsible for exporting and securely storing any important CCTV footage, files, configuration backups or other data.
  • Storage devices can fail and recordings may be overwritten as part of normal operation.
  • Unless specifically agreed in writing, NextWave Tech & Security does not continuously monitor, archive or back up customer recordings or data.
  • We are not responsible for data loss caused by equipment failure, overwritten recordings, power loss, account loss, cyber incidents or third-party services, except to the extent liability cannot lawfully be excluded.

14. Payment Terms

  • Unless otherwise agreed in writing, invoices are payable within 7 days of issue.
  • Approved commercial or business accounts may be provided with payment terms of up to 30 days.
  • Deposits, progress payments or payment before commissioning may be required for larger projects, special-order equipment or staged works.
  • Customers must notify us promptly if they believe an invoice contains an error. The undisputed portion remains payable by the due date.
  • We may suspend further works, support, monitoring arrangements or future bookings while an account remains overdue.
  • To the extent permitted by law, the customer may be responsible for reasonable administration, debt recovery, collection and legal costs incurred in recovering an overdue amount.

15. Ownership of Goods

To the extent permitted by law, ownership of goods and equipment supplied by NextWave Tech & Security remains with NextWave Tech & Security until all amounts owing for those goods have been paid in full.

Risk in installed equipment passes to the customer once the equipment has been delivered to or installed at the customer's property, except to the extent otherwise required by law.

16. Cancellations & Rescheduling

  • Customers should provide reasonable notice when requesting cancellation or rescheduling.
  • Additional charges may apply where technicians have already travelled, equipment has been ordered, access equipment has been booked or other costs have been incurred.
  • Deposits relating to special-order, configured or customer-specific equipment may not be refundable once the equipment has been ordered or prepared.
  • We may reschedule work due to unsafe weather, technician illness, product delays, emergencies or other circumstances outside our reasonable control.

17. Delays & Events Outside Our Control

NextWave Tech & Security is not responsible for reasonable delays caused by circumstances outside our control, including:

  • Severe weather, flooding, storms, fire or natural disasters.
  • Supplier shortages, backorders or discontinued products.
  • Freight, transport or customs delays.
  • Internet, telecommunications or power outages.
  • Government restrictions or regulatory requirements.
  • Illness, emergencies or unsafe site conditions.
  • Delays caused by customers, third-party contractors or service providers.

18. Photography & Installation Records

We may photograph equipment, cable routes and completed work for job records, quality control, technician training, warranty evidence and installation documentation.

We will not intentionally publish a customer's name, street address, personal information, identifying documents or security credentials without permission.

Where installation photographs are suitable for marketing, we may request the customer's consent before publishing identifiable images of their property.

19. Privacy & Customer Information

Customer information may be collected and used to prepare quotations, communicate about bookings, complete works, configure systems, provide support, issue invoices, maintain warranty records and meet legal or regulatory obligations.

Information may be provided to employees, contractors, suppliers, manufacturers, monitoring providers or other service providers where reasonably necessary to deliver the agreed services or process a warranty claim.

Customers must not provide our technicians with passwords or access credentials that they are not authorised to disclose.

20. Intellectual Property

Quotations, system designs, drawings, layouts, reports, programming, configuration methods, pricing structures, recommendations and supporting documents prepared by NextWave Tech & Security remain our intellectual property unless otherwise agreed in writing.

These materials are provided for the customer's evaluation and use in connection with the quoted project and must not be copied, distributed or provided to another contractor for commercial use without our written permission.

21. Limitation of Liability

To the extent permitted by law, NextWave Tech & Security is not liable for indirect, incidental or consequential loss caused by matters outside our reasonable control, including third-party outages, manufacturer failures, internet interruptions, cloud-service failures or customer-supplied equipment.

Nothing in these Terms & Conditions excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

22. Concerns, Defects & Opportunity to Rectify

Customers should notify NextWave Tech & Security as soon as reasonably possible if they believe there is a defect or problem with our work.

We must be given a reasonable opportunity to inspect and, where appropriate, rectify an issue before the customer arranges repair or alteration by another contractor, except in an emergency or where immediate action is reasonably necessary to prevent damage or ensure safety.

We may not be responsible for third-party repair costs where we were not first given a reasonable opportunity to inspect and rectify the issue, except where otherwise required by law.

23. Australian Consumer Law

24. Acceptance of These Terms

Acceptance of a quotation, payment of a deposit, confirmation of a booking, instruction to order equipment, authorisation to commence work, payment of an invoice or continued use of our services constitutes acceptance of these Terms & Conditions.

Where a quotation contains project-specific conditions that differ from these general Terms & Conditions, the project-specific written conditions will apply to the extent of the inconsistency.
